Terms of Service

These terms govern use of Sparkleflo, operated by [[Starla Jewels LLP]] (“we”, “us”). The organisation that signs up (“Customer”) accepts them, together with the Sparkleflo Subscription Agreement (version 2026-07-a) accepted at sign-up, through the person who creates the account. That person confirms they are authorised to bind the organisation. Individual users invited by the Customer use Sparkleflo on the Customer’s behalf.

• The Customer’s organisation admins control who is invited, each user’s role, and when access is disabled.
• Keep sign-in credentials confidential. The Customer is responsible for activity under its users’ accounts.
• Seats are limited by the subscription tier.
• We may access a Customer workspace to provide support or investigate a security issue. Every such session is time-limited, requires a recorded reason and appears in the Customer’s audit log.

• Subscriptions are billed monthly in the currency shown at sign-up, on the tier the Customer selects. A free trial may apply to new organisations.
• Generating images, videos and captions uses tokens. Each tier includes a monthly token allowance; additional token packs can be purchased. Generation stops when tokens run out until more are available.
• Prices exclude applicable taxes, which are added to invoices (for example, GST in India).
• Refunds: [[No refunds]].
• We may suspend an organisation for non-payment or a material breach of these terms, after notice where practicable.

• The Customer keeps all rights to the product photos, catalog data and brand materials it uploads, and grants us the rights needed to host, process and transmit them to provide the service — including sending them to the AI providers used for generation and checking, as described in the Privacy Policy.
• As between the Customer and us, the Customer owns the images, videos and captions generated for it, subject to the terms of the AI providers involved and to applicable law on AI-generated works.
• The Customer confirms it has the rights to everything it uploads or connects.

These conditions exist so that marketing made with Sparkleflo stays truthful:

• Faithful product representation. Generated imagery must show the real piece. The Customer must not use Sparkleflo to misrepresent a product’s metal, stones, carat weight, design or origin.
• Human approval. A person at the Customer must review and approve content before it is published. Automated checks assist but do not replace that review.
• Disclosure. AI-generated content carries disclosure labels, which the Customer must not remove where the law or a platform requires them.
• No real-person likeness. Model personas are fictional composites. The Customer must not upload or generate the likeness of a real person without that person’s documented consent.
• The Customer must not use Sparkleflo to break the law, infringe others’ rights, make claims it cannot substantiate, attempt to access other organisations’ data, or disrupt or reverse-engineer the service.
• The Customer is responsible for complying with the rules of each channel it publishes to.

Sparkleflo connects to services the Customer chooses — for example Shopify, its catalog or POS system, ad and social platforms, and AI providers under the Customer’s own API keys. Those services are governed by their own terms, and we are not responsible for their availability or conduct.

We work to keep Sparkleflo available but do not guarantee uninterrupted service. AI output can vary and may contain errors, which is why human approval is required. We may improve or change features; we will give notice of changes that materially reduce the service or these terms.

Sparkleflo is provided “as is” to the extent the law allows. Neither party is liable for indirect or consequential losses. Nothing in these terms limits liability that cannot be limited by law.

The Customer may stop using Sparkleflo at any time. On termination, access ends and Customer data is handled as described in the Privacy Policy. Sections that by their nature should survive termination (including 4, 8 and 10) do so.

These terms are governed by the laws of [[Hyderabad, India]], and the courts of [[Telangana, India]] have exclusive jurisdiction.
